 This contract includes free editing, free formatting, free cover design, free ISBN and free printer setup.

__________________________________ (Author) and Dare 2 Dream Books (Publisher) agree to enter into a working relationship to work together as detailed further in this contract for the purpose of producing, publishing, and distributing a book (“Title”) based on a manuscript submitted by Author to Publisher commencing on _______________________, (Effective Date) and remains in effect until terminated by ether party as set forth in this Agreement.

Both parties agree that the author reserves and retains all publication and copyright privileges to the manuscript and all other material Author submits to Publisher.

Author also retains all rights to distribution and selling of the manuscript in other print and digital formats.  Author grants Publisher the right to store and transmit digital versions of Title to facilitate publication, distribution, and sale of Title.

Author grants Publisher the right to exhibit, print, and distribute any and all related materials submitted in conjunction with Title, which includes, but is not limited to, cover art, interior and exterior images and concepts, author’s photograph, summaries, quotes, testimonials, and author’s biography, and furthermore grants Publisher the right to exhibit Dare 2 Dream Books logos or verbiage on any applicable submitted materials.

Manuscript must be submitted electronically using MS Word. 

When all that is left is a basic, grammatical edit of the manuscript prior to publication we enter into the final preparation for printing.  This phase will be agreed upon in writing by Author and Publisher, and all necessary, initial fees paid and agreement is made as to how and when balance of fees will be remitted.

Publisher will make all reasonable efforts to publish, print, and have ready for distribution (title) within 90 days of Publishers receipt of all materials required from Author in conjunction with Title.

Unless otherwise supplied by Author, Publisher will design the book block (The text of the book), front and back cover and spine, and will prepare the digital files necessary to print the manuscript in book form as set forth herein.  All reasonable efforts will be made to ensure that all pages are included in the book according to the author approved proof; cover is applied wit 1/16” variance; binding is applied and squared to the book page block without excessive visible adhesive; book is cut square according to Author’s selected trim size within 1/16” variance, cover and interior match the author approved proofs, and print registration is within +/- 1/16” variance.  UNLESS NOTED BOOK WILL BE 5.5x8.5 PERFECT BOUND.

Author will maintain the copyright for Title.  Unless otherwise supplied by Author, Publisher will secure a unique ISBN number for each print format of Title.

All fees owed must be paid in full prior to final publication and printing unless a written agreement is in place to the contrary.

 Publication / Printing / Distribution Phase

Representations and Warranties

Author represents and warrants that Author is the sole owner of the manuscript and all material submitted in conjunction with Title, including all submitted cover art work, interior images, and photograph of Author.  Author represents and warrants that Author has full power and authority to enter into this agreement and to provide to Publisher for reproduction, publication and distribution by Publisher all material submitted.

Author represents and warrants that this Agreement and the submission of the manuscript and all other material does not conflict with or violate any arrangement, understanding, or agreement between the Author and other persons or entities.

Author represents and warrants that the manuscript and all material submitted in conjunction with Title is entirely original, free of liens, claims, or interests of any kind; is not slanderous, pornographic, obscene, libelous, or defamatory; and does not violate or infringe upon any personal or proprietary rights including without limitation copyrights, trademarks, privacy rights, or publicity rights of other persons or entities.

Author represents and warrants that Author is eighteen years of age or older.  If Author is under the age of 18 years of age, then Author’s parent or guardian must also execute this Agreement and assume liability for the warranties and responsibilities set forth herein.

Fees, Costs, and Pricing—Publication phase

·         $80.00 Printer set up fee (Fee waived on initial order of 250 or more books)

·         $30.00 Proof mailed to you prior to printing (OPTIONAL)

·         In addition to direct sales, If Author chooses to have Title available through Amazon.com or Barnes & Noble.com.  Publisher will make Title available to these distributors at a 55% discount.  Publisher will reduce his cost to 30% of the retail and Author will earn 15% of retail. 

·         If Author chooses this option, Author is responsible for an $15 annual charge to keep Title in their catalogs.

TERMINATION OF AGREEMENT AND GOVERNING LAWS

This agreement shall be governed exclusively by and construed according to the laws of the State of Oklahoma without giving effect to conflicts of law principles.

Author may terminate this Agreement upon thirty-day prior written notice to Publisher.  Upon termination by Author all fees are forfeited and royalties will be paid on all books sold up to termination date.

Publisher may terminate this agreement at any time and immediately cease distribution of Title upon any claim that Title violates the copyright or other legal rights of any person or entity, or upon the discovery by Publisher that Author has violated any of the warranties or representations in this agreement.   Publisher may also terminate this agreement prior to publication upon failure of Author to pay amounts due or upon failure of Author to respond within 30 days to Publisher’s request for information.  Upon termination by Publisher all fees are forfeited and royalties will be paid on all books sold up to termination date.

CHRISTIAN MEDATION/ARBITRATION AGREEMENT

In the event of any issues that cannot be resolved through simple negotiations both parties agree to submit to binding Christian mediation/arbitration through an organization or person agreed upon by both parties.

By signing this agreement and submitting the required materials, Author and Publisher agree to be bound by the terms and conditions of this agreement for the publication, printing, distribution and sale of Title.
